These Terms of Service (“Terms”) govern your access to and use of the website at funderscollective.io and the services provided by Funders Collective (“Funders Collective,” “ we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The services

Funders Collective provides business-to-business lead-generation services, sourcing and delivering business-financing leads to brokerages and lenders. Specific commercial terms — including pricing, volume, lead criteria, delivery, and replacement policies — are set out in a separate order form, insertion order, or written agreement between you and Funders Collective(a “Service Agreement”). If a Service Agreement conflicts with these Terms, the Service Agreement controls for that engagement.

Eligibility

You must be at least 18 years old and authorized to act on behalf of the business you represent. The Services are intended for business use, not for personal, family, or household purposes.

Bookings and communications

When you book a call or submit a request, you agree that we may contact you at the email address and phone number you provide regarding your inquiry and our Services.

Fees and payment

Fees for the Services are described in your Service Agreement. Funders Collective generally operates on a pay-per-lead basis. Unless otherwise stated in writing, fees are non-refundable except as provided by an applicable replacement or credit policy in your Service Agreement.

Client responsibilities and acceptable use

• You are solely responsible for how you contact and communicate with leads, including compliance with all applicable laws and regulations (for example, the Telephone Consumer Protection Act, state telemarketing and Do-Not-Call rules, and commercial-financing disclosure laws).
• You will not use the Services for any unlawful, deceptive, or abusive purpose, and you will not resell or redistribute leads except as permitted in writing.
• You will not attempt to disrupt, reverse engineer, or gain unauthorized access to the Services or our systems.

Intellectual property

The website, its content, and the Funders Collective name and logo are owned by Funders Collective or its licensors and are protected by applicable laws. You may not copy, modify, or distribute them without our prior written permission.

No guarantee of results

Funders Collective does not guarantee that any lead will convert, that you will fund any particular number of deals, or that you will achieve any specific revenue or return. Outcomes depend on many factors outside our control, including your sales process, timing, and market conditions.

Disclaimer of warranties

The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Funders Collective will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or relating to the Services. Our total liability for any claim relating to the Services will not exceed the amounts you paid to us for the Services giving rise to the claim in the three months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Funders Collective and its officers, employees, and agents from any claims, damages, and expenses arising out of your use of the Services or your violation of these Terms or applicable law, including your outreach to leads.

Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. The courts located in New Jersey will have exclusive jurisdiction over any dispute arising from these Terms or the Services.

Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted, and the “Last updated” date above reflects the latest revision. Your continued use of the Services means you accept the updated Terms.
